What Is a Special Leave Petition
A Special Leave Petition, commonly called an SLP, is a request for permission to appeal to the Supreme Court of India under Article 136 of the Constitution. This jurisdiction is discretionary. Filing a petition does not give an automatic right to an appeal or a favourable decision. [6]
An SLP differs from a transfer petition. A transfer petition concerns moving a pending proceeding between courts. An SLP seeks permission to challenge a judgment or order through the Supreme Court’s appellate jurisdiction. [1, 6]
When an SLP May Be Considered
An unfavourable order should first be examined to identify the appropriate remedy. Depending on the decision and governing law, that remedy may involve an appeal, review or another proceeding.
Where an SLP is appropriate, the petition should explain why the challenged decision warrants the Supreme Court’s attention. The legal assessment examines the reasoning, applicable law and procedural history, including whether a material legal error or serious injustice is raised. A fresh hearing of every factual disagreement is not automatic.
Taps9 Law approaches this review by considering the complete judgment alongside the relevant record, rather than relying only on a short account of the dispute.
Civil and Criminal Special Leave Petitions
Civil SLPs may arise from appropriate matrimonial, property, commercial or other civil proceedings. Criminal SLPs can involve challenges to orders or judgments in criminal matters. Maintainability and the correct remedy must be assessed in each case.
Criminal matters may require additional attention to custody, sentence and surrender requirements. The documents and applications needed depend on the relief sought and the procedural position. [5]
Filing Deadlines and Limitation
For a civil SLP, the ordinary period is 90 days from the judgment or order challenged, or 60 days from an applicable High Court order refusing a certificate of fitness to appeal. These periods are subject to the governing rules and limitation provisions.
Criminal SLPs have their own rules, including special treatment for death sentence matters. Do not assume that a general 90 day period applies to every case. Delay may require a request for condonation supported by reasons, and acceptance is not automatic. Obtain a case specific calculation promptly. [4]
Documents for an Initial SLP Review
Prepare the complete challenged judgment or order, relevant earlier orders, pleadings and documents from the proceedings below. A chronology of key dates, details of earlier remedies and any urgent enforcement or custody issue will also help the review.
An SLP is prepared with reference to the lower court record. Additional documents require compliance with the applicable procedure; they should not be treated as automatically admissible. [5]
How Taps9 Law Can Assist
Our assistance includes reviewing the challenged decision, identifying the questions and grounds to be raised, organising the case chronology and helping prepare the petition and necessary procedural applications.
If the matter proceeds, the filing arrangements and scope of professional work should be settled clearly. Supreme Court filing and acting through an advocate require an Advocate on Record under the applicable rules. [4]
The Court may dismiss the petition, seek a response or grant leave, depending on its assessment. If special leave is granted, the matter proceeds as an appeal. Any interim protection depends on the Court’s directions. [4, 5]
Frequently Asked Questions
Is an SLP the Same as an Appeal
An SLP asks for permission to appeal under Article 136. The Court first considers whether to grant special leave. The filing itself does not mean that leave has been granted. [6]
Does Filing an SLP Automatically Stay the Challenged Order
No. Interim relief must be requested where appropriate. The challenged order continues to operate unless the competent court grants a stay or other relevant protection. [5]
Can an SLP Be Filed After the Normal Deadline
A delayed filing may require an application explaining the delay. The Court decides whether the explanation justifies condonation; an extension cannot be promised. [4]
Is an SLP the Same as a Review Petition
No. An SLP seeks special leave to appeal. A review petition asks the court that delivered a decision to review it within the applicable legal framework. The correct remedy depends on the decision and circumstances. [4]
Do I Need to Live in Delhi to Discuss an SLP
You do not need a Delhi residential address for an initial consultation about an appropriate Supreme Court matter. The Supreme Court sits in New Delhi, while the underlying case may arise elsewhere in India. Any attendance requirements depend on the proceedings and court directions. [6]
